The MBE consists of one full day of testing, separated into two 3-hour sessions. Each session covers 100 multiple-choice questions covering six main areas of law:
- Torts
- Contracts
- Constitutional Law
- Evidence
- Crimes
- Real Property

The six areas of law are sub-divided into major sub-topics. The National Conference of Bar Examiners (NCBE), who develops and distributes the MBE to bar examiners around the country, provides information how each subject and major sub-topics are tested.
